1 Validity of the General Terms and Conditions

These General Terms and Conditions apply to all offers and other services by the Deutsche Golf Sport GmbH (hereinafter only DGS) in connection with the participation in the German Long Drive Championship (hereinafter GLDC) and the use of the offers on the website www.germanlongdrive.de. The validity of general terms and conditions of business deviating from these is expressly contradicted.

2 Object of the German Long Drive Championship

The German Long Drive Championship offers interested persons the opportunity to play golf in a long drive specific format. In order to participate in the GLDC, it is necessary to acquire an eligibility to participate, which can be found and purchased under the following URL www.germanlongdrive.de .

Provider of the URL www.germanlongdrive.de and operator of this website is the DGS, Kreuzberger Ring 64, 65205 Wiesbaden.

3 Acquisition and participation in the GLDC

The right to participate in the GLDC can be acquired via the URL www.germanlongdrive.de or directly via the DGS.

Participation in a GLDC event is free of charge for amateurs. The registration fee for professionals is 200€.

The acquisition of the right to participate in the GLDC via the online shop at www.germanlongdrive.de is only possible in German and English. All prices shown in the online shop include the statutory value added tax applicable at the time. As far as costs of a postal dispatch arise, these are shown separately.

In order to participate in the GLDC the online shop requires the following information:

- Name and first name of the participant;

- the e-mail address of the participant;

- Address of participant

Before sending the order, the information can be checked again and, if necessary, corrected. By selecting the "Buy Now" button at the end of the ordering process, the user makes a binding offer to DGS to acquire the right to participate in the selected GLDC event. This offer is accepted by DGS subject to prior express acceptance by issuing a confirmation of participation. After sending the order, the user will receive a confirmation of his order via electronic form. This order confirmation does not constitute an acceptance of the contractual offer made by the user. In the case of a conclusion of a contract DGS does not store any further information beyond the details contained in the order confirmation.

The right to participate is personal and cannot be transferred to third parties. Commercial trade with the eligibility to participate in the GLDC is prohibited.

Therefore, the DGS strongly recommends that before acquiring the right to participate in a GLDC event, you should inform yourself about the conditions of participation and The Rulebook of the GLDC. The Conditions of Participation and The Rulebook are an integral part of these General Terms and Conditions. By accepting the general terms and conditions, the participant also declares his or her agreement with them.

DGS reserves the right to cancel the participant's eligibility to participate in a GLDC event if the participant does not fulfil his or her contractual obligations, in particular if payment obligations are not met by return debit note.

4 Withdrawal

The participant may withdraw from participation at any time. However, he is obliged to pay the costs incurred by DGS for processing the participation. If the participant withdraws after the registration deadline, no refund of the amount paid can be made.

The participant is at liberty to prove that DGS has suffered a minor loss.

5 Liability

DGS makes every effort to ensure the proper operation of the web site at all times, but does not guarantee the uninterrupted availability of the URL www.germanlongdrive.de , nor does it guarantee or accept liability for technically induced transmission delays, faulty transmissions or failures. With the exception of cases of gross negligence or intent, DGS is in particular not liable for the unauthorized acquisition of personal user data by third parties (e.g. hackers).

In any case, DGS's liability remains unaffected - both in terms of the cause and the amount - for damages caused intentionally or by gross negligence, as well as for damages resulting from injury to life, body or health. Furthermore, the limitation of liability does not apply to claims under the Product Liability Act or to damages resulting from the (slightly) negligent violation of essential contractual obligations. A contractual obligation in this sense shall be deemed to be all obligations whose fulfilment is essential for the proper execution of the contract and on whose compliance the contractual partner regularly relies and may rely, and whose restriction leads to the undermining of legal positions of the contractual partner which are essential to the contract, for example because they remove or restrict such rights which the contract must specifically grant according to its content or purpose.

6 Obstacles to performance

If an event must be cancelled by DGS due to force majeure or other circumstances, the participant and DGS are released from their obligations to perform. The participation fee will be refunded. Force majeure includes, for example, war, natural disasters, pandemics, official prohibitions, etc.

7 Terms of payment

The participant can choose from the available payment methods during and before completion of the order process. The participants will be informed about the available payment methods on a separate information page.

If third-party providers are commissioned with the payment processing, e.g. Paypal, their general terms and conditions apply.

If the due date of payment is determined by the calendar, the participant is already in default by missing the deadline. In this case, the participant must pay the statutory default interest.

8 Privacy Policy

Personal data is processed within the scope of the contract processing. The privacy policy lists further information.

9 Final clauses

Should one of the provisions of these General Terms and Conditions of Business be or become invalid or void - regardless of the legal basis - the validity of the remaining provisions shall not be affected. In this case, the ineffective or void provision shall be replaced by a new provision which comes closest to the intended purpose of the ineffective or void provision.

German law is applicable.

Place of jurisdiction is Wiesbaden.
